Terms of Service

1. Agreement to Terms

By accessing or using the Build-On platform (“Platform”), including our website, mobile applications, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

Build-On is operated by Build-On Technologies Inc. (“Build-On”, “we”, “us”, or “our”), a company incorporated in British Columbia, Canada.

2. Description of Services

Build-On is a construction supply delivery platform that connects three types of users:

  • Contractors — individuals or businesses who order construction materials for delivery to their jobsites.
  • Suppliers — building supply stores that list their product catalogs and fulfill orders placed through the Platform.
  • Drivers — independent delivery partners who pick up orders from suppliers and deliver them to contractor jobsites.

Build-On facilitates the connection between these parties but does not itself manufacture, warehouse, or sell construction materials. Build-On is not a supplier, retailer, or carrier.

3. Account Registration

  • You must provide accurate, current, and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Business accounts may invite additional users. The account administrator is responsible for the actions of all users they invite.
  • You must be at least 19 years of age to create an account (the age of majority in British Columbia).
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Contractor Terms

4.1 Orders

When you place an order through Build-On, you are requesting the purchase and delivery of materials from a third-party supplier. Prices, availability, and product descriptions are provided by the supplier and may change without notice.

4.2 Payment

  • Material costs are charged to the payment method on file — either a credit card or a supplier credit account, depending on your arrangement with the supplier.
  • Delivery fees and platform service fees are charged separately to your credit card.
  • Applicable taxes (GST/PST) are estimated at checkout and finalized upon order completion.

4.3 Cancellations & Restocking

  • Orders may be cancelled at any time before the status reaches “Picked Up”.
  • If an order is cancelled after picking has started but before pickup, a restocking fee may apply. The fee amount is set by the supplier (default $5.00 CAD).
  • Once a driver has picked up the order, cancellation is no longer available.

4.4 Delivery & Verification

Orders are verified at pickup using a 6-digit PIN code shared between the supplier, driver, and contractor. You are responsible for ensuring someone is available at the delivery address to receive the order. If delivery cannot be completed due to an inaccessible jobsite or absent recipient, additional fees may apply.

5. Supplier Terms

5.1 Catalog & Pricing

Suppliers are responsible for maintaining accurate product listings, pricing, and stock availability on the Platform. Build-On does not guarantee the accuracy of any supplier-provided information.

5.2 Order Fulfillment

Suppliers agree to accept and fulfill orders in a timely manner. Consistently failing to fulfill orders, excessive cancellation rates, or misrepresenting product availability may result in account suspension.

5.3 Verification

Suppliers must complete the verification process before accepting orders. This may include providing business registration documents, proof of insurance, and other documentation as required.

5.4 Fees

There are no monthly fees for suppliers to list on Build-On. Build-On charges a per-transaction service fee on completed orders. Fee schedules are provided during onboarding and may be updated with 30 days' notice.

6. Driver Terms

6.1 Independent Contractor Status

Drivers are independent contractors, not employees of Build-On. Nothing in these Terms creates an employment, partnership, or agency relationship between drivers and Build-On.

6.2 Requirements

Drivers must meet the following requirements:

  • Be at least 19 years of age
  • Hold a valid BC Class 5 or Class 7N driver's licence
  • Have access to a reliable vehicle suitable for material delivery
  • Maintain ICBC delivery-class vehicle insurance
  • Pass a criminal and driving history background check
  • Have a smartphone capable of running the Build-On driver app

6.3 Conduct

Drivers must handle all materials with care, follow safe driving practices, and treat contractors and suppliers with professionalism. Build-On reserves the right to deactivate driver accounts for unsafe behaviour, excessive complaints, or failure to maintain eligibility requirements.

6.4 Compensation

Drivers are compensated on a per-delivery basis. Rates are calculated based on distance, order size, and other factors. Payouts are processed on demand through the driver app. Build-On is not responsible for driver tax obligations — drivers are responsible for reporting their own income.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Misrepresent your identity, business, or relationship with any person or entity
  • Interfere with or disrupt the Platform or servers connected to the Platform
  • Attempt to gain unauthorized access to any part of the Platform or other accounts
  • Use automated systems (bots, scrapers) to access or interact with the Platform without written permission
  • Harass, threaten, or intimidate other users of the Platform

8. Disputes & Issue Resolution

If you experience an issue with an order — including missing items, damaged materials, incorrect products, or delivery problems — you may report the issue through the Platform. Build-On will facilitate resolution between the relevant parties but is not liable for the actions or omissions of suppliers or drivers.

For disputes that cannot be resolved through the Platform, parties agree to attempt mediation before pursuing legal action. Any legal proceedings shall be governed by the laws of British Columbia and the federal laws of Canada applicable therein.

9. Limitation of Liability

To the maximum extent permitted by law, Build-On shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Build-On's total liability for any claim shall not exceed the fees paid by you to Build-On in the twelve (12) months preceding the claim.

Build-On does not guarantee the quality, safety, or legality of materials sold by suppliers, the ability of suppliers to fulfill orders, or the ability of drivers to complete deliveries.

10. Intellectual Property

The Build-On name, logo, and all related marks are trademarks of Build-On Technologies Inc. The Platform and its original content, features, and functionality are owned by Build-On and are protected by copyright, trademark, and other intellectual property laws.

11. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Platform. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

12. Termination

Either party may terminate the relationship at any time. You may delete your account through the Settings page or by contacting support. Build-On reserves the right to suspend or terminate your access to the Platform at any time for violations of these Terms, with or without notice.
